High court dismises Bawku Central MP application

Accra, July 22, Ghanadot - The
embattled Member of Parliament (MP) for Bawku Central in the
Upper East Region, Hon Adamu Dramani has suffered another
legal setback in his bid to keep his seat.
Hon Dramani's application for a
stay of execution filed by his lawyers has been thrown out
by the Accra High Court at today's sitting.
The High Court presided over by Justice K.A. Asiedu, ruled
July 16 that Mr Dramani could no longer continue to hold the
seat because he held dual citizenship at the time he filed
nomination papers for the seat.
At its latest ruling the court held that Mr Dramani had
refused to commence his defense although he was given ample
time to do so and several invitations made to him to proceed
with a defense.
The court therefore decided to throw out Mr Dramani’s
application for a stay of execution on that grounds.
Mr Yoni Kulendi, lawyer for the embattled MP had prayed the
court to stay execution on its default judgment, advancing
the argument that the court must not be compelled to give a
verdict on “an issue that must be determined on its merit.”
But Dr Raymond Atuguba, lawyer for the plaintiff, Sumaila
Bilbil, established that Mr Dramani had had enough time to
file a defense but had refused to do so and that the court
must not delay judgment on the matter.
After having his application thrown out, Mr Dramani is said
to have commenced an appeal against against the High Court’s
decision.
